Terms of Service
These Terms of Service ("Terms") govern your use of Spit, a macOS application ("the App") developed and distributed by Spit ("we", "us"). By downloading or using the App, you agree to these Terms.
1. The App and Licence
Spit is a macOS application that provides voice-to-text dictation, text-to-speech reading, and automatic translation features. You are granted a personal, non-exclusive, non-transferable licence to use the App on macOS devices that you own or control, subject to these Terms and the rules of the Apple App Store.
You may not:
- Reverse-engineer, decompile, or disassemble the App
- Redistribute, sell, or sublicence the App to third parties
- Remove or alter any copyright or proprietary notices
- Use the App for any unlawful purpose
2. Subscription and Billing
Spit is available as an auto-renewable subscription managed entirely through the Apple App Store:
- Free trial: New subscribers receive an introductory free period (currently one month) before the first charge. The duration of the free trial may vary and is displayed at the time of subscription.
- Spit subscription (€4.99/month): Unlimited voice dictation and AI text-to-speech reading, billed monthly. Cancel any time.
All billing, payment processing, and subscription management are handled exclusively by Apple. Prices may vary by region and are displayed in your local currency in the App Store. By subscribing, you authorise Apple to charge your Apple ID account according to the subscription terms displayed at the time of purchase.
We reserve the right to change the subscription price with reasonable prior notice. Price changes will be communicated in advance; continued use after the effective date constitutes acceptance of the new price.
3. Service Limits
Dictation (voice to text) is provided without a usage limit for active subscribers.
Text-to-speech reading is subject to a generous monthly processing allowance. The allowance is designed to comfortably accommodate normal individual use — equivalent to many hours of audio reading per month — and resets at the beginning of each calendar month. The specific allowance may be adjusted over time; current limits are available in the App. We will provide reasonable notice before reducing any limit below what is sufficient for typical use.
We reserve the right to apply additional rate limiting or suspend access to the service in cases of suspected abuse, automated use, or usage patterns that significantly exceed individual normal use.
4. Free Trial and Introductory Offers
Introductory offers (including free trial periods) are available to new subscribers only — users who have not previously subscribed to Spit through the same Apple ID. Eligibility is determined by Apple. After the introductory period ends, your subscription converts automatically to the standard paid plan at the then-current price.
5. Cancellation and Refunds
You can cancel your subscription at any time through your Apple ID account settings or the App Store. Cancellation takes effect at the end of the current billing period; you retain full access to the service until then.
Because billing is handled by Apple, all refund requests are subject to Apple's refund policy. To request a refund, visit reportaproblem.apple.com. We do not process refunds directly.
6. Acceptable Use
You agree to use Spit only for lawful purposes. You must not use the App to:
- Record or transcribe conversations without the knowledge and consent of all parties, where required by applicable law
- Generate, distribute, or store illegal content
- Use automated scripts or bots to generate dictation or reading requests
- Attempt to bypass usage limits through technical means
- Attempt to gain unauthorised access to our systems or infrastructure
7. Intellectual Property
Spit and all related branding, design, code, and documentation are the intellectual property of Spit. The transcribed text and audio output produced using the App belong to you.
8. Disclaimer of Warranties
The App is provided "as is" without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be error-free, uninterrupted, or that transcription results will be accurate. Transcription accuracy depends on voice clarity, background noise, language, and the capabilities of the underlying AI services.
9. Limitation of Liability
To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, even if we have been advised of the possibility of such damages. Our total liability to you shall not exceed the total amount you paid for the App in the 12 months preceding the claim.
10. Third-Party Services
Spit relies on third-party AI services (Groq, OpenAI) and infrastructure (Cloudflare, Apple App Store) to operate. We are not responsible for the availability, performance, or changes in these services. Significant changes to underlying services that affect functionality will be communicated in advance where reasonably possible.
11. Changes to the App and Terms
We reserve the right to modify the App or these Terms at any time. We will provide notice of material changes by posting an update on our website and updating the date at the top of this document. Continued use of the App after changes take effect constitutes acceptance of the updated Terms.
12. Governing Law
These Terms are governed by and construed in accordance with the laws of Portugal, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Portugal, unless applicable consumer protection law in your jurisdiction provides otherwise.
